TERMS OF SALE

 

1. All EPIC Cane Corsos are registered with the I.C.C.F., International Cane Corso Federation, and A.K.C. Foundation Stock Service, and will carry the EPIC Cane Corsos name as their registered name. We breed to the I.C.C.F. standard.

 

2. I.C.C.F. and A.K.C. FSS registration papers are given once proof is given of a completed puppy kindergarten class. Pet quality puppies’ application for registration after proof of spay/neuter has been received.

 

3. All puppies are guaranteed to be free of communicable disease at the time of sale per health certificate provided with puppy at time of sale under Florida state law. The buyer must have puppy examined by a licensed veterinarian within 72 hours from date of delivery. Failure to do so will result in all guarantees being canceled. Seller accepts no responsibility for any communicable diseases after 72 hours.

 

4. If a serious health problem is noted during the above examination, a written statement from buyers’ veterinarian must be received by seller within 7 days from the date of examination. Upon verification by sellers’ veterinarian of stated health problem, puppy must be returned to seller. When available, no time frame is guaranteed, the buyer will be provided with another puppy, of the same sex and quality/value.

 

5. All puppies are guaranteed to be free of any birth defect. Problems must be reported within 1 year of date of sale.

 

6. All show quality puppies are guaranteed to be free of Crippling Hip Dysplasia up to the age of 2 years.OFA pre-lims will not be accepted as the final diagnosis of hip dysplasia, the radiograph must be preformed again at the age of two years at which time results will be accepted as final. If at any time before the age of 2 years it is deemed by a certified veterinarian that the puppy needs any type of orthopedic surgery, buyer must notify seller before giving permission to veterinarian to proceed with surgery. Buyer must send copies of x-rays, doctors’ report etc., to sellers’ veterinarian. Buyer must also obtain a second opinion from a veterinarian not associated with original veterinarian that gave the recommendation for surgery, Sellers veterinarian may be source of second opinion. If buyer proceeds with surgery without first contacting seller all terms of replacement of puppy will become null and void.

 

7. SHOW QUALITY: Upon knowledge of any birth defect or genetic defect, buyer agrees to have his/her veterinarian provide seller with written proof of problem within 7 days of occurrence. Diagnosis must be confirmed with seller’s veterinarian. Buyer has two options: 1. Buyer may elect to keep puppy, have him/her spayed/neutered proof of sterilization must be provided, return registration papers and receive $1000.00 off the purchase of a new show puppy. 2. Buyer may elect to return puppy to seller along with registration papers and receive a replacement puppy. If the puppy/dog has been bred all guarantees are null and void. For the terms of this contract "Cherry Eye" is considered common to the breed and non-hereditary and is not covered under the contract.

 

-Any puppy sold as a show quality must be shown unless the seller agrees to and signs a waiver. Puppy must attend its first show by the age of six to nine months and be shown a minimum of six times by the age of two years. Buyer understands that failure to do so will result in a fine being imposed on them which will amount to the purchase price of the puppy or puppy may be returned to seller in which case seller agrees to take $500.00 off the purchase price of a PET quality puppy when available. Puppy must not have been spayed or neutered and must be in good health which will be confirmed by sellers veterinarian.

 

-Any female puppy sold as a show quality puppy must not be bred before two years of age at which time the official OFA radiograph can be performed, buyer understands that breeding a female before two years of age will cause all terms of this contract to become null and void.

 

-Buyer agrees to never intentionally breed this Cane Corso with any other breed of dog except another Cane Corso. Buyer understands if Seller becomes aware of this practice occurring, a fine will be imposed on buyer which will amount to the purchase price of the dog. Buyer may keep dog but it must be spayed or neutered immediately proof of sterilization will be required. Buyer may return dog to seller in which case seller agrees to take $500.00 off the purchase price of a PET quality puppy. Dog must not have been spayed or neutered and must be in good health which will be confirmed by sellers veterinarian. This condition is imposed in order to keep the breed pure.

 

-Registered name of dog will begin with “EPIC”new owner may state rest of name. Unless new owner was involved with the actual breeding of said animal they will not add their kennel name to the naming of this dog. Such as EPIC George of/di your kennel.

 

8. Under NO circumstances do we grant cash refunds or accept liability for medical expenses, veterinarian fees, or any other expense related to the care of your Cane Corso.

 

9. No replacements will be given due to problems which result from buyers neglect.

 

10. No guarantees are made regarding temperament. The temperament of your puppy is based on the amount of time you give to your dog and to its development and socialization. Buyer agrees to enroll puppy in Puppy Kindergarten class at 3 months of age and Basic Obedience by 6 months of age with a certified trainer in a class setting. It is also recommended that you enroll your dog in a refresher course at 12 months. Under no circumstances should rough training methods be used on your Cane Corso. Proper socialization and training is a must for your puppy to be a well adjusted, welcome member to your family. Registration papers WILL NOT be released until proof of completion of puppy kindergarten has been received.

 

11. Buyer agrees to provide yearly vet exams. Puppy should be on a food formulated for large breeds. We recommend you feed a high quality puppy food, as proper diet will help your puppy maintain good health.

 

12. Seller is not responsible for any problems with landlord, family members or allergy.

 

13. Buyer is responsible for all shipping charges, and means of shipping, for puppy and or replacement puppy, which also includes return of original puppy to seller.

 

14. REPLACEMENT PUPPY

 

-In the case of sudden or unexplained death, a full necropsy must be done to show cause of death, to prove a pre-existing genetic disorder.

 

-Verification must be provided that puppy completed Puppy Kindergarten and Basic Obedience classes during the time frame recommended in #10 of this contract. Failing to complete these classes voids contract.

 

-Dog/Bitch must have not been bred. Breeding of said animal will void contract.

 

-Verification of proper veterinary care and feeding as stated in contract must be provided.

 

-Replacements are made when puppies are available. No guarantee is made as to time frame for replacement.

 

15. Contract is not valid unless signed by buyer and seller. Buyer MUST return a signed original of contract within 7 days. If signed copy is not returned, no guarantees will be honored.

 

16. VENUE, APPLICABLE LAW AND ATTORNEY FEES:

 

-This agreement is mutually stipulated to have been entered in Brevard County, Florida regardless of where it is signed. Buyer and Seller agree that the proper venue for any legal action to enforce the terms and conditions of this agreement shall lie in Brevard County, Florida, and that this agreement shall be interpreted in accordance with the laws of the state of Florida. Both parties agree that any incurring legal fees are the responsibility of their own.

 

17. FIRST RIGHT OF REFUSAL:

- Buyer must give seller first right of refusal if at any time they find they can no longer keep possession of above mentioned dog.

 

18. If any term or provision of this agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining terms and provisions shall continue in full force and effect and shall in no way be effected, impaired or invalidated.

 

19. TRANSFERABILITY:

 

This contract is limited between Seller and 1st Buyer. It is not held transferable to a third party.

 

20. Sellers maximum responsibility is limited to the purchase price of the dog. Any subsequent expenditure is the sole responsibility of the Buyer.

 

21. By signing this contract both parties are acknowledging they have read fully understand and  agree to ALL terms of this contract they also agree that all terms will be carried out as stated. Any other agreements are invalid unless stated in writing at the time of the signing of this agreement.
